HOW TO ENTER 1. Instructions on how to claim form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All sections of the form shown overleaf must be completed in full to be eligible for product return. Offer not valid in conjunction with any other offer, unless specifi ed otherwise. 2. Claims are only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. This offer is valid for purchases made from an Olympus authorised retailer. 3. Promotion commences on 15.02.2009 and ends on 31.05.2009 (“Promotional Period”). Claims close last mail received 10.07.2009. 4. This offer is valid for the following Olympus camera packages purchased during the Promotional Period from an authorised participating retailer in Australia and for 30 days from the date of purchase by the claimant: Mju 9000 Black and Champagne 5. This offer does not apply to any accessories purchased in connection with the Camera, including but not limited to, camera straps, storage memory, or cases etc. 6. To claim a refund, the claimant must visit (www.olympus.com.au) download and complete the official claim form, including providing their requested details, attach the original purchase receipt and send to “Olympus 30 Day DSA Lens Guarantee, PO Box 1991 Macquarie Centre NSW 2113” to be received by Olympus within 40 days of purchase. Claimants must retain a copy of purchase receipt(s) for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an claimant’s claims and forfeiture of any right to an offer. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to claim. 8. If the camera was purchased with an extended warranty provided by the place of purchase, or under finance plan offered by the place of purchase, the claimant must return the camera to the place of purchase for a refund. In all other cases the promoter will arrange a courier to pick up the camera. Please allow 28 days from date of pick up to process refund. 9. In order to be eligible for a refund, the Camera must: (a) be returned as it was at the time of purchase. For example, Cameras must be packed in their original cardboard boxes along with any packaging and any manuals, leads, lens and lens caps etc, i.e. the box contents as outlined in the checklist that appears on the claim form and (b) have been used under normal conditions and maintained according to the instructions supplied. If the claimant causes damage to the Camera, the Promoter in its absolute discretion may either refuse the refund or reduce it to take account of the damage caused by the claimant. 10. Every valid claim will receive a cheque equal to the purchase price paid for the Camera as a refund. 11. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 12. Incomplete, indecipherable, or illegible claims will be deemed invalid. 13. Multiple claims permitted, subject to the following: (a) only one claim permitted per Camera purchased; and (b) each claim must be submitted and in accordance with claim requirements. 14. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant. 15. The Promoter’s decision is final and no correspondence will be entered into. If the claimant of offer is under the age of 18 years, the refund will be awarded to the claimant’s nominated parent or guardian. 16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) participation in the offer. 17.Certain legislation may imply warranties or conditions or impose obligations upon the Promoter which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extend. These conditions must be read subject to those statutory provisions. If those statutory provisions apply, to the extent to which the Promoter is able to do so, its liability will be limited. 18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. If the claimant marks the appropriate box on the claim form, the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter. 19.
