CASHBACK Terms and Conditions - 1. Instructions on how to claim form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer, unless otherwise advised.
2. Claims are only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister or 1st cousin.
3. Promotion commences on 01.10.08 and ends on 31.12.2008 (“Promotional Period”). Final claims close last mail received on 15.01.2009.
4. The offer is only available on the purchase of an Olympus E-520 Body only, E-520 Single Lens Kit (14-42mm lens), E-520 Twin Lens Kit (14-42mm lens and 40-150mm lens), E-520 Super Tele Kit (14-42mm lens and 70-300mm lens) or E-520 Quatro Kit 33x Zoom ( 9-18mm lens, 14-42mm lens, 40-150mm lens and 70-300mm lens) from an authorised participating retailer in Australia during the promotional period.
5. To claim, claimants must then enter the unique code found within the packaging of Olympus E-520 cameras or where this code is not available, go online to http://cb.olympusimaging.com.au and enter their details.
6. Claimants with a unique promotional code in pack can either go online to http://cb.olympusimaging.com.au and enter the code by following the prompts or SMS the code to 61428407501 using their mobile phone and follow the prompts via return SMS.
7. For claimants with a code, payment will be made via PayPal by the next working day once your claim has been received. If payment does not occur by the next working day, call this number for assistance 1300 974 655 or email cashback@olympusimaging.com.au
8. Where no code is present in pack, simply go to http://cb.olympusimaging.com.au and follow the prompts to the cash back promotion and enter your details. Follow the instructions online. You will be asked to send your original purchase receipt after you complete the official entry form online, including providing requested details, unique code and the serial number, attach original purchase receipt and send to “Olympus Cash Back Offer”, PO Box 1632 North Sydney NSW 2060”.
9. For entrants without a unique code payment will be made via PayPal within three weeks of the date of postage of the original receipt. If payment does not occur by the next working day, call this number for assistance 1300 974 655 or email cashback@olympusimaging.com.au.
10. The Promoter reserves the right, at any time, to verify the validity of claims (including contacting the place of purchase) and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The claimant agrees that if they have obtained the cash back, they will pay back the Promoter $100, if they subsequently return the camera to the place of purchase and seek a refund under any returns policy that the relevant store may have.
11. Incomplete, indecipherable, or illegible claims will be deemed invalid.
12. Multiple claims permitted, subject to the following: (a) only one claim permitted per specified purchase requirement; and (b) each claim must be submitted in accordance with claim requirements.
13. Claimants must retain a copy of purchase receipt for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to an offer. Purchase receipt must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to claim.
14. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. Every valid claim received will be awarded a AUD$100 cash back. Cash back will be awarded in the form of a payment into a PayPal account specified by the email address of the claimant or by cheque.
17. It is the responsibility of the claimant to provide the correct details for the PayPal account for the cash back payment to be made into. Where a claimant does not have a PayPal account he or she can create one and should go to www.paypal.com.au for more information and to read the Product Disclosure Statement issued by PayPal. Payments into a PayPal account will be made by the next working day where a valid unique code has been submitted or when the original receipt has been received and validated. Please note that withdrawals of less than $150 from a PayPal account incur a $1 fee.
18. If the claimant wishes to receive a cheque this process will take up to 45 days to process and the claimant must email cashback@olympusimaging.com.au for instructions on how to claim via cheque.
19. If the claimant of offer is under the age of 18 years, the cash back will be awarded to the claimant’s nominated parent or guardian.
20. Cash backs are not transferable or exchangeable.
21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of property); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the offer value to that stated in these Terms and Conditions; or (e) participation in the offer.
22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. If the claimant marks the appropriate box on the claim form, the Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Claimants should direct any requests to access, update or correct information to the Promoter. All claims become the property of the Promoter.
